The Terms and Conditions apply upon access to our website “FloridaEyeglasses.com”, the “website” or “site” and any and all Websites provided. BY AFFIRMATIVELY ACKNOWLEDGING YOUR AGREEMENT TO THESE TERMS AND CONDITIONS WHICH INCLUDE ALL USE OF OUR WEBSITE, YOU ARE AGREEING TO THESE TERMS AND CONDITIONS, WHICH CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND THE COMPANY. 

Terms and Conditions may be modified from time to time and the date of modification will be posted at the bottom of the page. Orders placed are subject to the terms and conditions posted at the time of purchase. Any proposed changes to the terms and conditions will be outlined thirty (30) days in advance of implication. Changes will not apply to any purchases made prior to the date of change. Anyone not agreeing to the terms and conditions are warned not to proceed as their purchase as purchasers are bound to all current terms and conditions. 

SALES & PURCHASES: the following information is requested by all purchasers and necessary to complete your order: (1) purchaser’s full name and correct and complete address and shipping information, (2) current phone number of which you are to be contacted if necessary, (3) current e-mail address. (4) Payment information (credit card number, including expiration date and CVC (card verification code), (5) frame selected (if applicable), (6) lens and material type (7) any additional specialty coatings, (8) pupillary distance (PD) (if not available, purchaser may send a “selfie” and the licensed Optician will determine to the best of his/her ability to measure). Purchaser agrees to accept the PD determined, (9) Prescription. Purchaser will input the prescription provided to them by their eye care professional. If purchaser’s prescription is more than two (2) years old, it is recommended that purchaser confirm that the prescription is accurate. All information, excluding payment information, will be stored for future orders. Purchaser is responsible for providing updates upon future orders. 

CHANGES TO YOUR ORDER: After placing an order, you will have twenty-four (24) hours to revise and update the order information you have provided. Following this twenty-four (24) hour period, you will not be able to revise or update your order information. Cheaprxeyeglasses.com is not responsible for any errors in information provided by the purchaser or person who placed the order. 

PLACING YOUR ORDER: When you place your order, you represent that: (1) the information you submit is truthful and accurate; (2) your use of the website does not violate any applicable laws or regulations; (3) you are of sufficient legal age (over the age of 18) or otherwise have legal capacity to legally enter into these Terms and Conditions. 

PRIVACY POLICY: Cheaprxeyeglasses.com reserves the right to send promotional information through direct mail and internet Websites that include promotion coupons, sales and Websites, and other digital means. The website is public and anyone wishing to browse the site may do so without the obligation to make a purchase. However, you will not be able make a purchase or request information prior to submitting your contact information. 

All orders may only be shipped to addresses in the continental United States and are shipped from the Florida, US to the address listed as the “ship to” address.Most general or stock orders will be processed and shipped within one (1) to two (2) weeks. Special orders should allow three (3) to four (4) weeks. Purchasers will have the option to track packages. Your purchase is subject to government inspection, shipping delays, weather delays, and other unforeseeable events. Therefore timing of delivery, receipt of the order by you and other timing expectations might be delayed or impaired and orders may take longer than expected. We do not guarantee a specific delivery date. 

You will have thirty (30) days to return your eyeglasses under the following conditions; If you are not satisfied with eyeglasses you have ordered from us, you may return those eyeglasses in their entirety, free from damage, including entire frame and lenses, and you may elect to receive either (a) a fifty percent (50%) refund (excluding shipping), which will be issued back to the credit card used to place the order, or (b) a one hundred percent (100%) refund (excluding shipping) in the form of credit to be used on an alternate purchase through cheaprxeyeglasses.com. You must contact us in advance, in writing to Joe@FloridaEyeglasses.com to inform us of the reason for returning your purchase. Orders paid for with Store Credit can only be returned for a 50% refund of the Store Credit amount used to pay for the order. The refund will be issued to the credit card used on the preceding order for which store credit was issued. For orders where both Store Credit and a credit card are used to pay for the order, the Store Credit portion will only be eligible for a 50% refund while the portion paid for by credit card will be eligible for either 50% refund or issuance of a 100% store Credit. SHIPPING CHARGES WILL NOT BE REFUNDED UNDER ANY CIRCUMSTANCES. PURCHASER MAY ONLY RETURN AN ORDER ONE TIME. IF AFTER A REFUND ORDER IS FILLED, PURCHASER IS STILL UNSATISFIED, PRIOR APPROVAL FROM CHEAPRXEYEGLASSES.COM MAY MAKE AN ACCEPTION BASED ON CIRCUMSTANCE. 

DEFECTS: Manufacturing and Other Defects. If your eyeglasses have a manufacturing defect you must return them within thirty (30) days of the date of delivery of your order and we will replace them at no charge. We are not responsible for damage caused by customer or wear and tear. If you are returning your eyeglasses because of a manufacturing defect, you must e-mail a photo of the defect and a short description explaining the problem to Joe@FloridaEyeglasses.com. To receive a replacement order, glasses must be returned in their entirety (frames, lenses, eyeglass case, etc.). Include a copy (not the original version) of the prescription used when placing the original order. If the glasses are reasonably found by us to have a manufacturing defect, we will refund $5.00 back to the credit card used to place the order as partial reimbursement of your shipping fees. We regret that we cannot issue refunds to any credit card or payment account other than the credit card you used to place the applicable order. If the credit card you used to place the applicable order is no longer valid or a refund cannot be made to that credit card, then the amount of the refund will be issued as a store credit only to the customer account used to place the applicable order. 

DISCOUNTS: Sales, promotions and coupons my only be used as advertised and my not be modified, extended or combined with other deals. We do not have an obligation to honor any coupons or coupon codes that are posted on third party websites or otherwise provided by third parties. 

THIRD PARTY SITES: The Website may contain links to websites operated by third parties (“Third Party Sites”), such as Facebook, Twitter and Instagram pages through links on the Website, and you may be able to share information with Third Party Sites through links on the Website; however, we do not own or operate the Third Party Sites, and we have not reviewed, and cannot review, all of the material, including goods or services, made available through Third Party Sites. The availability of these links on the Website does not represent, warrant or imply that we endorse any Third Party Sites or any materials, opinions, goods or Websites available on them. Third party materials accessed through or used by means of the Third Party Sites may also be protected by copyright and other intellectual property laws. These terms and conditions do not apply to Third Party Sites and anyone visiting a Third Party Site through Cheaprxeyeglasses.com should not rely on these terms and conditions and should contact the Third Party Vendor to obtain governing information related to that particular site. 

USER CONTRIBUTIONS: You may be able to submit comments and content to the Website, including uploading photographs in connection with the Cheaprxeyeglasses.com website. You are entirely responsible for the content of, and any harm resulting from, any Contributions that you provide on or through the website. We do not make any representations that the Website or any Materials are available or appropriate for use in your location. Your use of or access to the Website should not be construed as the Company purposefully availing itself of the benefits or privileges of doing business in any state or jurisdiction. 

NO MODIFICATIONS BY OUR EMPLOYEES: If any of our employees offers to modify the terms of these Terms of Use, he or she is not acting as an agent for us or speaking on our behalf. All parties agree that any disputes that require a Court of Law must be handled in the State of Florida, in the County of Flagler. 

INDEPENDENT CONTRACTORS: Nothing in these Terms of Use shall be deemed to create an agency, partnership, joint venture, employer-employee or franchisor-franchisee relationship of any kind between us and any user. 

ASSIGNMENT: We may assign our rights under these Terms of Use without your approval.
